Agreeing to these terms

These terms apply when you use the Hawke's Bay News website or our mobile apps. By using them, you agree to them. If you don’t agree, please don’t use them.

Who we are

Hawke's Bay News is an independent, locally owned news platform reporting on Napier, Hastings and the wider Hawke’s Bay region. You can reach us at editor@hawkesbaynews.co.nz.

Using the site and apps

You may read, link to and share our journalism freely. What you may not do is:

• republish our stories, photographs or video in full without our permission;
• scrape, harvest or bulk-copy the site, including for training machine learning models, without our written permission;
• interfere with the site or apps, attempt to gain access to parts of them that aren’t public, or use them in a way that disrupts other readers;
• use them for anything unlawful.

Our content

The stories, photographs, video and design on this site belong to us or to the people we licensed them from, and are protected by copyright.

You’re welcome to quote a reasonable extract for the purposes of reporting, review, criticism or discussion, as long as you credit Hawke's Bay News and link back to the story. For anything more than that — syndication, reprinting, commercial use — email us and ask. We are usually happy to say yes.

Accuracy, and getting it wrong

We work hard to get our reporting right, and to keep it current. Even so, news is published quickly and under deadline, and we don’t promise that everything on the site is complete, accurate or up to date at the moment you read it.

Nothing we publish is professional advice. Don’t rely on a news story for legal, financial, medical or safety decisions — get advice that takes your own circumstances into account.

If we have published something that is wrong, we want to know. Email us and we will look into it and correct it where a correction is warranted.

News tips and material you send us

If you send us a tip, a photograph, video or other material, you keep ownership of it. You give us permission to publish and edit it across our website, apps and social channels, and to keep it in our archive.

By sending it, you confirm it is yours to send, and that publishing it won’t breach someone else’s rights. We decide what we publish, and we are not obliged to publish anything you send.

Please don’t send us confidential material you are not free to share. If you need to discuss how material will be handled before you send it, contact us first.

Advertising

We carry advertising from local businesses, and advertisements are identified as such. We are not the seller of the goods or services advertised, and we are not responsible for what an advertiser does, sells or says on their own website. If you buy something from an advertiser, that transaction is between you and them.

Links and embedded content

We link to other websites and sometimes embed video hosted elsewhere. We don’t control those sites and aren’t responsible for their content or their handling of your information. Once you follow a link or start an embedded video, that provider’s own terms apply.

The apps

We grant you a personal, non-exclusive licence to use our apps on devices you own or control, for reading the news. The app store you installed from has its own terms, and those apply as well as these.

Breaking news alerts are optional. You choose whether to turn them on, and you can turn them off at any time in the app’s Settings screen or in your phone’s notification settings.

Availability

We aim to keep the site and apps available, but we don’t promise they will be uninterrupted or error-free. We may change, suspend or withdraw any part of them, including individual stories, at any time.

Liability

To the extent the law allows, we are not liable for any loss arising from your use of, or reliance on, the site or apps, or from them being unavailable.

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot be excluded. If you are using our service for business purposes, those consumer guarantees do not apply.

Which law applies

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute about them.

Changes to these terms

We may update these terms from time to time. The current version is always the one on this page, and the date at the top tells you when it last changed.
